Terms of Service
The agreement between you and us: what you can expect from CandleDraw, what we expect from you, and what happens when either of us wants to stop.
Last updated 2 September 2026
1.The agreement
CandleDraw is operated by JG Tromp, trading as CandleDraw. In these Terms, “we” and “us” mean that trader, and “you” means the person using the service.
Creating an account means you accept these Terms and our Privacy Policy. If you are accepting them for an organisation — a school, an academy, a trading education business — you confirm you are authorised to bind it, and “you” includes that organisation.
If you do not accept these Terms, do not create an account. There is no signed-out use of the canvas, so declining costs you nothing.
2.What CandleDraw is
CandleDraw is a drawing tool. You use it to produce candlestick charts as illustrations, for a lesson, a video, an article or a journal entry, and to export them as images. A chart here is drawn by hand, generated from statistics, or imported from an OHLC file you supply.
What that rules out is worth stating plainly, because the subject matter invites the opposite assumption. CandleDraw has no market feed. It does not connect to an exchange or a broker, it holds no account and places no order, it tracks no portfolio and values no position, and it produces no signal, alert or recommendation. Nothing on the canvas is live, and no price on it is ever checked against a market.
We sell access to software, not education. We publish no course, lesson or training material, and none is bundled with any plan. The Educator tier is tooling for people who teach: cohorts, assignments, and review. What gets taught with it is the educator’s, and Running a cohort sets out where that line falls.
We are not affiliated with anyone in the market. We have no relationship with any broker, exchange, proprietary trading firm, signal service or trading course. Nobody pays to be named in CandleDraw, we take no commission, rebate or referral fee from anywhere we link to, and we sell no advertising. Where the product does point at an outside source, as the import panel does at a public archive of historical price data, it is because the source is useful and free to use. That is not an endorsement and it earns us nothing.
The one referral arrangement in CandleDraw runs the other way, and is set out in Referral links: an educator can earn a commission when someone they referred subscribes to CandleDraw itself. Nothing is ever paid to us, or by us, for sending you to a third party.
3.CandleDraw is not financial advice
CandleDraw is a drawing and teaching tool. It does not provide financial or investment advice, and nothing produced with it is a recommendation to buy, sell, or hold anything.
The charts you create here are illustrations. They are hand-drawn, generated from statistics, or imported from a file you supply. CandleDraw carries no market feed of its own: nothing on the canvas is live, nothing updates by itself, and no price is ever checked against a market. A drawn or generated chart describes nothing that happened anywhere unless you have deliberately reproduced it, and an imported one is only as accurate as the file it came from, which we neither provide nor verify. Candle pattern detection, Fibonacci levels, volume profile and the other analysis tools are drawing aids that compute over whatever candles are on the canvas, including the simulated volume the product estimates and discloses when real volume is absent.
We are not a broker, investment firm, or financial adviser, and we are not regulated as one. We publish no course, lesson, or training material of our own, and none is bundled with any plan: educators using CandleDraw teach on their own authority, and what they teach is theirs, not ours. Any trading decision you make is yours, and trading carries the risk of losing money.
4.Your account
You need an account to use the canvas. You can create one with Google, an email link, or an email address and password. Keep your credentials to yourself; you are responsible for what happens under your account until you tell us it has been compromised.
You must be at least 16 years old to create your own account. If you are under 18, you may only subscribe to a paid plan with the consent of a parent or guardian.
Students under 16 must be enrolled by their educator, who is responsible for obtaining whatever parental consent their own law requires before adding a student to a cohort. See Running a cohort.
One person, one account. Sharing an account across a class defeats every assignment and submission boundary in the product.
5.Plans, payment, and renewal
CandleDraw has a Free tier and paid Pro and Educator tiers. Current features and prices are on the pricing page, which is the authoritative statement of what each plan costs and includes. The Free tier is the trial: it is limited by candle and layer count rather than by time, and it does not expire.
Creem is the seller for every paid subscription. Creem acts as merchant of record: your purchase contract for the subscription is with Creem, your receipt and invoice come from Creem and name Creem, and Creem is responsible for charging and remitting any VAT or sales tax due where you live.
We never receive or store your card number. What Creem tells us is which plan is active, its status and billing period, when the period ends, the identifiers of your customer and subscription records with Creem, and, for our own administration, the amounts and dates of your payments. That is enough to unlock what you paid for and to answer a question about a charge, and it includes nothing about your card.
This does not change who you deal with. CandleDraw is still ours to run and support, these Terms still govern your use of it, and refund and cancellation requests still come to us — see Refunds and cancellation. It changes who the transaction is legally with, which matters for tax and for how a card dispute is handled.
Paid plans are sold monthly or annually and renew automatically at the end of each period, at the price then published, until cancelled. Prices shown include VAT: the amount on the pricing page is the amount you pay.
You can cancel at any time from the customer portal in your account settings, or by emailing support@candledraw.com. Cancellation takes effect at the end of the period you have already paid for — your plan keeps working until then, and you are not charged again.
Once an annual plan has renewed, you do not have to wait a further year to leave. Tell us at any point after that renewal and the plan ends within one month, and we refund the unused part of the period you had paid for. This is the right that covers a renewal; the 14 days in Refunds and cancellation cover a new subscription.
If a payment fails, Creem manages the retry and subscription status. If the subscription lapses, your account returns to the Free tier.
When a paid plan ends, for any reason, the projects you saved under it can no longer be opened. Saved projects are part of the Pro and Educator plans. Once your account is on the Free tier, whether because you cancelled, chose a lower plan, or a payment failed, the Projects menu is not available and your saved projects cannot be opened, listed or saved over. They are not deleted: they stay stored and become available again if you subscribe to a paid plan later. The chart on your canvas at the time stays where it is, but content beyond the Free tier's limits becomes read-only until you resubscribe or reduce it. Export any project you want to keep before your plan ends.
We may change prices. An increase applies from your next renewal, and we will tell you before it takes effect, in time for you to cancel.
6.Refunds and cancellation
If you are a consumer in the EU or the UK, you have 14 days to change your mind, and we refund you in full. The 14 days run from the day your subscription starts. You do not need a reason, and we deduct nothing for the days you used it.
This applies to a new subscription. A renewal of one you already have does not start a fresh 14 days: it continues the same agreement, and what applies then is the ordinary rule below, plus the separate right to leave a renewed annual plan in Plans, payment, and renewal.
To withdraw, email support@candledraw.com within those 14 days, or send us any other clear statement that you want to withdraw — the wording below is enough, and so is anything that says the same thing. We refund within 14 days of hearing from you, by the route you paid.
To JG Tromp, trading as CandleDraw, support@candledraw.com: I hereby give notice that I withdraw from my contract for the supply of the following service: [your plan]. Ordered on: [date]. Name: [your name]. Date: [today].
You can also evaluate CandleDraw indefinitely before paying. The Free tier is limited by candle and layer count rather than by time, so there is no trial to expire and no need to buy in order to find out whether the product suits you.
Outside that, subscriptions are billed in advance and fees are non-refundable: if you simply stop using a plan partway through a period, we do not refund the rest of it. What we do refund is set out in the two paragraphs below and in Plans, payment, and renewal.
We refund amounts charged in error — a duplicate charge, or a charge after cancellation — at any time. We also refund the unused period in two further cases described elsewhere in these Terms, both of which are our doing rather than yours: if we remove something you are paying for (see Availability) or close your account for a reason that is not your fault (see Ending the agreement).
Where to ask. Email support@candledraw.com — we handle refund requests even though Creem is the merchant of record, and coordinate with Creem to issue the refund. Money returns by the same route it arrived, to the card you paid with. Because Creem is the seller, your bank statement and invoice name Creem rather than us; that is the expected appearance, not a sign of anything wrong.
Nothing in this section limits your statutory rights as a consumer, including rights against a service that is not as described. Questions about a charge: support@candledraw.com.
7.Your drawings stay yours
You own everything you create with CandleDraw: your charts, annotations, uploaded logos, assignment material, and course structure. We claim no ownership of any of it.
To run the service we need a narrow permission: you grant us a licence to store, copy, and display your content only as needed to operate CandleDraw for you — saving your document, syncing it between your devices, showing an assignment to the students it was set for, and showing a submission to the educator who set it. That licence is non-exclusive, worldwide only because the servers are, and ends when you delete the content or your account.
We do not use your drawings to train machine-learning models, and we do not publish, sell, or share them with anyone beyond what the paragraph above describes.
One thing to know: watermark logos are stored in a public bucket so they load on your exported charts without a signed link. Anyone with the URL can fetch one. Do not upload anything there that should stay private.
8.Running a cohort
The Educator tier lets you create cohorts, invite students, publish curriculum and assignments, and review what comes back. It is software for running a course, not a course: nothing you teach with it comes from us. If you do teach, you take on obligations to your students that we cannot take on for you.
You are responsible for:
- Telling your students what you collect and why. You decide who is in your cohort, what work you set, and how long you keep it. In data-protection terms you are the controller of your cohort's data and we act on your instructions, on the terms of our Data Processing Agreement, which supplements these Terms and applies from the moment you start teaching.
- Consent for minors. If your students are under the age at which they can consent for themselves where they live, obtaining parental consent is your job, before you add them.
- What you teach. Your course material, feedback and grading are yours. We do not review them and are not responsible for them.
- What you can see. Being an educator gives you access to the profile and submitted work of students who joined through your link or cohort. Use it to teach, and for nothing else.
- What reaches a student, and when. Work travels to a student only through a curriculum section you release to a cohort they are in. An assignment in no released section reaches nobody however finished it looks, a student in no cohort receives nothing, and where you release a section sequentially the next assignment opens as you approve the one before it.
That release is the only way in. We do not add students to your cohorts, publish or release your curriculum, or open an assignment to a student you have not released it to. Access follows your releases and is checked on our servers rather than only in the interface, so it does not depend on what a student's browser is willing to ask for.
Any arrangement between an educator and a student is between them. What a course costs, when it runs, what it promises, and what happens if either of you is unhappy with it are yours to agree and yours to settle. We are not a party to it, we take no payment for it, and we do not mediate, arbitrate, or decide who is right when it goes wrong. That includes money that changes hands outside CandleDraw: a plan bought here is between us and the account that bought it, and nothing else.
What we do act on is our own rules. An account that breaks Acceptable use can be suspended whichever side of a disagreement it is on, and we will answer a lawful request about our own service. Enforcing these Terms is not a ruling on your dispute, and it is the only step we take in one.
Students: work you submit is visible to the educator who set the assignment, and the account you signed up with is visible to the educator who referred you. If you would rather your educator not see a drawing, do not submit it.
9.Referral links
Educator accounts get referral links. When someone signs in after following one, the referral is recorded against your account and reported back to you. A referral is claimed once, on first sign-in, and you cannot refer yourself.
A referral link by itself provides attribution and reporting. Commissions are governed by the affiliate agreement. Educator accounts may earn a commission on payments made by the students attributed to them. The rate, what counts towards it, the payout threshold and how payouts are made are shown in the app and set out in the affiliate agreement — a separate agreement supplementing these Terms, which you read and accept in the app before your referral link is issued. If you have not accepted it, you do not have a commission. Refunded payments reverse what they earned.
Do not promote your link with spam, misleading claims about what CandleDraw does, or any suggestion that we endorse a trading strategy or promise a return. We may cancel a referral code, and withhold anything attributed to it, if it is used that way.
10.Acceptable use
Do not:
- break into, probe, or overload the service, or try to reach data that is not yours — including another user's documents, cohorts, or submissions;
- work around plan limits, entitlement gating, or the sign-in requirement, by technical means or by sharing accounts;
- upload anything unlawful, infringing, or malicious, or a logo you have no right to use;
- use CandleDraw to present fabricated charts as real market history in order to mislead someone — particularly to sell them something;
- resell or white-label the service without our written agreement;
- scrape, bulk-download, or automate the product beyond ordinary personal use.
Automated abuse protections sit in front of the support form, and rate limits apply across the service. Circumventing them is itself a breach of this section.
11.Reporting content
Some of what users upload can be seen by others: a watermark logo loads from a public address, and a shared link shows a chart to whoever holds it. If something on CandleDraw infringes your copyright, or is otherwise unlawful, email support@candledraw.com with a link to it, a description of what it infringes or why it is unlawful, and a way to reach you.
We acknowledge every such notice. Where it is well founded we act promptly, usually by removing the content or disabling the link, and we tell the account that posted it what was removed and why. A notice sent in bad faith may be disregarded, and an account that repeatedly posts infringing content can be closed under Ending the agreement.
12.Availability and changes to the service
We aim to keep CandleDraw available and its data intact, but we do not promise uninterrupted service. Maintenance, provider outages, and faults happen. The service is provided as it is, without warranties beyond those the law gives you and does not let us exclude.
The product changes. We add and improve features, and occasionally remove one. If we remove or materially reduce something you are paying for, we will tell you in advance, and you may cancel and receive a pro-rata refund of the unused period.
Keep your own copies of work that matters. Export is fast and it is the shortest path in the product for a reason.
13.Ending the agreement
You can stop at any time: cancel your subscription in the customer portal, or delete your account from your profile settings. A renewing subscription must be cancelled before account deletion. Deleting the account removes your profile, documents, projects, cohort memberships, submissions, local billing mappings, entitlements, and uploaded logos, as described in the Privacy Policy.
We may suspend or close an account that breaches these Terms — immediately where the breach is serious or puts other users' data at risk, otherwise after telling you what is wrong and giving you a fair chance to fix it. If we close a paid account for a reason that is not your fault, we refund the unused period.
If you are an educator and your account closes, tell your students first. Their accounts and their own drawings survive; their membership of your cohorts and submissions to your assignments do not. Export anything you need first.
14.Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit. If you are a consumer, your statutory rights stand regardless of this section.
Otherwise, and to the extent the law allows: we are not liable for lost profits, lost trading opportunities, lost or corrupted data where you had a reasonable chance to export it, or losses that were not foreseeable when you agreed to these Terms. Our total liability for any claim is limited to what you paid us in the twelve months before the claim arose. If you have not paid us anything, we have no monetary liability to you.
We are specifically not liable for trading losses. See CandleDraw is not financial advice.
15.Changes to these Terms
We will update these Terms as the product changes. For a minor correction we update the page and the date at the top. For a material change — fees, refunds, liability, or how your content is used — we will email you at least 30 days before it takes effect.
If you do not accept a material change, cancel before it takes effect and we will refund the unused part of your period. Continuing to use CandleDraw after that date means you accept the new version.
16.Governing law and disputes
These Terms are governed by the law of the Netherlands, and the courts of Amsterdam, the Netherlands have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings there. If we ever need to bring proceedings against you as a consumer, we will do so only in the courts of the country you live in.
Please email support@candledraw.com first. Nearly everything is faster to fix than to litigate. If we cannot resolve a complaint between us, you may also take it to a consumer dispute body in your country; tell us where you live and we will say which one applies.
